EPCRA (Tier II)

Wake County uses E-Plan as the filing system for EPCRA (Tier II) reports. Submission through E-Plan satisfies the requirements to file with local first responders, emergency management, Local Emergency Planning Committee and the State. Wake County does not accept paper copies of Tier II reports.

Wake County requires reporting according to the limits provided by the North Carolina Hazardous Chemical Right to Know Act. If your facility has stored 500 pounds, 55 gallons or the Threshold Planning Quantity (whichever is smallest) of any material considered hazardous by OSHA for 24 consecutive hours or more, you must report it. This applies if the material was present on-site at any time during the past year.

Reporting opens on January 1 and closes on March 1 at midnight.

Who Needs to File?

Do you have chemicals that are required by OSHA to have a Safety Data Sheet (SDS) or a Material Safety Data Sheet (MSDS)?

NO

You do not need to file.

YES

You have 500 pounds, 55 gallons or more of a chemical listed on your SDS or MSDS as hazardous at any one time. The total quantity of 500 pounds includes when the chemical is used as a component of other chemicals.
You need to file.

OR

You have over the Threshold Planning Quantity (TPQ) as per the EPA of an Extremely Hazardous Substance (EHS). The reporting limit is whichever is smaller – 500 pounds, 55 gallons or the TPQ. Check the EPA List of Lists to find out if a chemical is considered EHS.
You need to file.

Filing Tier II Reports

E-Plan

In North Carolina and Wake County, E-Plan is the only option for filing Tier II data as required by law. Call 919-856-6480 if you have any questions regarding the requirements for Wake County.

EPCRA/Tier II Report Review Criteria

  1. Company name is reported identically across all facilities leased or owned by the company. Facility names may be unique.
  2. Have a minimum of three (3) unique points of contact with unique phone numbers.
  3. Fire department listed matches the correct fire response zone for the facility.
  4. Address matches mailing address for the physical facility.
  5. Latitude/longitude are located directly on top of the facility.
  6. Correct, current CAS numbers are present for materials that have CAS numbers. For mixtures, CAS numbers of components are listed.
  7. If required, HazMat box is present on the property as per the Wake County HazMat ordinance.
  8. Site specific plan is complete using the Wake County LEPC template (see below).
  9. Site specific plan has been reviewed and updated if necessary within the past year.

The following planning template has been developed to assist your facility in complying with the planning, prevention, control and mitigation of dangerous conditions created by the presence of hazardous materials required under the Emergency Planning and Community-Right-to-know Act of 1986 (EPCRA) and the Hazardous Materials Chapter of the North Carolina State Building Code.
